1. About DonPic

DonPic, available at https://donpic.com, provides tools for sports photographers to create online shops, build portfolios, upload albums, share links and sell digital photographs.

These terms govern use of DonPic, photo purchases and DonPic Plus subscriptions.

Operator: Redon Mihana, operating DonPic
Address: Flat 2, 121 Marlyn, Triq L-Iskal, Marsascala, MSK 2134, Malta
Contact: support@donpic.com

DonPic supplies the platform and its membership services. Photographers supply their photographs and grant the applicable photo licences.

Mandatory legal rights take priority over any conflicting provision of these terms. Accepting these terms is not consent to optional tracking or marketing.

2. Accounts and acceptable use

Photographer accounts and paid subscriptions are intended for people aged 18 or over, or authorised representatives of businesses. Buyers must have legal capacity to purchase; where necessary, a parent or guardian must make the purchase.

Provide accurate information, protect your login details and notify support of suspected unauthorised access.

Do not use DonPic for fraud, harassment, unlawful content, infringement of others’ rights, impersonation, unauthorised access or interference with the service. Do not bypass payment or download protections.

Sports content and prohibited uploads

DonPic is intended exclusively for sports photography. This applies to album photos, covers, profile pictures, descriptions and links, including private or unlisted albums.

You must not upload, sell, promote or link to:

  • Pornography, sexually explicit material or content focused on sexual activity or exposed intimate body parts.
  • Sexualised images of children, child sexual abuse material or sexual exploitation.
  • Non-consensual intimate images, voyeuristic material or manipulated intimate images, including sexual deepfakes.
  • Material infringing copyright, privacy or other rights.
  • Hate content, credible threats, scams or other unlawful material.
  • Unrelated adult entertainment or non-sports products and services.

Ordinary lawful sports photographs, including sportswear, swimming or shirtless athletes, are not prohibited solely because of that clothing or context. Photographers must respect privacy, dignity and the rights of children and other participants.

DonPic does not review every photograph before publication and does not currently use automatic explicit-image screening. Availability on DonPic does not mean we approved the content or verified every permission. We may investigate reports and take action under section 11.

3. Photographer responsibilities and ownership

Photographers retain copyright unless they have agreed otherwise with the relevant rights holder. Uploading does not transfer copyright to DonPic or a buyer.

By uploading content, you confirm that you own it or have sufficient rights to upload, display, distribute and license it. You must have the permissions and lawful grounds required for identifiable people, children, locations, events and other protected material.

Permission to enter or photograph an event does not necessarily include every right needed for commercial distribution.

Photographers must accurately describe their work, set lawful prices and meet applicable business and tax obligations. Buyer information obtained through DonPic must not be used for unrelated marketing without an appropriate legal basis.

You grant DonPic a non-exclusive licence to host, store, resize, generate watermarked previews, display and technically distribute uploaded content as reasonably needed to provide the service and fulfil purchases.

This does not give DonPic a general right to sell your content independently or use it in unrelated advertising.

The platform licence continues only as needed for these purposes, including existing orders, disputes and justified retention. Removing an album does not revoke valid licences already granted to buyers.

4. Albums, previews and originals

Photographers control the available album visibility options. Private or unlisted links can be forwarded by recipients; a shared link is not a guarantee of confidentiality.

Previews may be reduced in size and watermarked. After successful payment, buyers receive access to the purchased original files without DonPic’s preview watermark. File characteristics depend on the uploaded originals and the information provided before purchase.

Any download expiry or download-count restriction must be disclosed before purchase and in the order confirmation.

Customers should save purchased files and keep backups. DonPic does not promise permanent online storage of downloads. Photographers should also keep their own original-file backups.

Watermarks and technical protections discourage misuse but cannot guarantee prevention of screenshots, copying or unauthorised editing.

Removing an album from public view does not necessarily erase stored originals immediately. See the Privacy Policy for retention and deletion information.

5. Buying photos and delivery

The photographer identified for the selected photograph is its seller and licensor. DonPic provides the marketplace and technical delivery service and supplies DonPic Plus.

Before ordering, customers must be given the seller’s identity, applicable trader or non-trader status, relevant contact information, the allocation of responsibilities and the final price. Consumer protections can differ when buying from a trader or a private individual. Contact support if this information is missing or unclear.

This allocation does not override responsibilities imposed by law on DonPic or a photographer.

Buyers may select one photo or multiple available photos. Review the selections, price, currency, licence and any applicable taxes or charges before confirming payment. The final payable total must be shown before the order is placed.

Payments are processed through the methods offered at checkout, including Stripe. An unsuccessful or unconfirmed payment does not grant a download licence.

After successful payment, original-photo download links are normally sent to the email address supplied for the order. Check that address and your spam folder.

For missing links, invalid downloads or incorrect files, contact support@donpic.com with your order reference.

Downloads require internet access, access to the order email and software compatible with the image format offered. Photographers must accurately describe relevant file characteristics before sale.

6. Standard personal-use photo licence

After full payment, the photographer grants the buyer a non-exclusive, worldwide licence for personal, non-commercial use of the purchased photograph. The licence has no fixed end date, subject to these terms and applicable rights of others.

You may:

  • Download and keep the photograph for yourself.
  • Print copies for personal use or private gifts.
  • Post it on personal social-media accounts, including ordinary non-sponsored posts about your sporting participation.
  • Crop or resize it for those uses, provided this does not create a misleading or unlawful impression.

Without separate permission from the photographer and other necessary rights holders, you may not:

  • Resell, sublicense or supply the image as a stock photo or downloadable product.
  • Use it in paid advertising, sponsored promotions, business campaigns, merchandise or other commercial exploitation.
  • Give others the original file for independent use, publish download links or make it available as a reusable asset.
  • Claim to have taken the photograph or remove copyright information or a photographer’s signature to misrepresent authorship.
  • Use it unlawfully, deceptively or in a way that falsely suggests endorsement.

Copyright ownership is not included. Buying a photograph does not automatically grant model, personality, trademark or event rights held by others.

For team, club, sponsor, media or other business use, request a separate licence before use.

This standard licence applies to purchases made under these terms. It does not retrospectively replace a different licence agreed for an earlier purchase.

7. Free plan, commission and payment fees

The Free photographer plan has no monthly DonPic membership fee.

DonPic charges 10% commission on the photographer’s photo-sale amount recorded in an eligible order, after any supported discount and before payment-processing fees.

Payment-processing fees are deducted separately from the photographer’s earnings.

For example, a €100 commissionable photo sale has €10 DonPic commission on Free. Applicable payment-processing fees further reduce the photographer’s final earnings.

Processing fees vary by payment and provider. These terms do not promise a fixed processing-fee percentage.

Any payout, currency-conversion or dispute charges passed to photographers must be disclosed and agreed before they apply. This clause does not authorise undisclosed charges.

8. DonPic Plus

DonPic Plus costs €5.99 per month, billed in advance and renewing automatically each month until cancelled.

The billing page and checkout must clearly state the currency, tax treatment, final recurring total and renewal terms before subscription.

While Plus is paid and active, DonPic commission is 0% on new photo sales associated with the eligible photographer account. This includes new purchases from previously uploaded and newly uploaded albums.

Plus does not refund commission on earlier orders or change an existing order’s recorded commission rate.

Payment-processing fees still apply. Plus does not mean photographers receive the entire customer payment without deductions.

Cancel monthly renewal using Cancel renewal on the DonPic Plus page in your photographer dashboard. Manage billing provides available billing options. If these controls are inaccessible, contact support@donpic.com.

Cancellation normally takes effect at the end of the paid monthly period, with benefits continuing until then. There is no minimum commitment beyond the current monthly period.

When paid eligibility ends, the account returns to Free and its commission applies to new sales. Profiles and albums remain available under Free, subject to these terms.

An unpaid, expired, suspended, refunded or disputed membership may not qualify for Plus benefits. Contact support if the status is incorrect.

Cancellation stops future renewals. It does not automatically create a discretionary refund for an unused part of a month. Statutory withdrawal and other refund rights remain protected.

9. Withdrawal rights, problems and refunds

Contact support@donpic.com with your order or subscription reference and an explanation of the problem. This does not shorten statutory deadlines or prevent you exercising rights by another legally valid method.

Where consumer withdrawal rights apply, distance contracts generally have a 14-day withdrawal period, subject to legal exceptions.

To exercise an applicable withdrawal right, send a clear statement that you wish to withdraw. Include your name, contact details, order or subscription reference and purchase date.

Digital-photo purchases

A change-of-mind withdrawal right may be lost once supply begins only where the legally required prior express consent, acknowledgement and contract confirmation have been provided.

Merely accepting these terms or paying does not replace those requirements.

Rights concerning faulty, incorrect, misdescribed or undelivered photographs remain protected.

DonPic Plus

Plus is an ongoing service. The digital-photo exception does not automatically remove withdrawal rights for Plus.

If a consumer expressly requests the service to begin during the withdrawal period, a proportionate charge for service already supplied may apply only where permitted by law.

Remedies and refunds

Depending on the circumstances, statutory remedies can include correct supply, bringing content into conformity, a price reduction or termination and a refund.

These terms do not impose a blanket “no refunds” rule.

Refunds required by law will be processed within the applicable deadline. For an applicable consumer withdrawal, reimbursement is normally due within 14 days after notice, using the original payment method unless another method is expressly agreed, without reimbursement fees.

Model withdrawal form

Use this form only to exercise an applicable statutory withdrawal right. A clear statement by another legally valid method is also sufficient.

10. Photographer payments and payouts

Photographers must complete the payment setup and verification required for the current payment mode before accepting eligible purchases or receiving payouts.

Stripe may request further verification or restrict an account under its terms and legal obligations.

Sales totals, earnings and available payout funds are different amounts. Processing fees, DonPic commission, release periods, processing time, refunds and disputes may affect availability.

New photographer earnings have a one-day DonPic waiting period before release to the photographer’s Stripe balance, subject to completed verification and justified refund, dispute or security holds.

Stripe processing and bank settlement may take additional time.

Changes to the waiting-period setting apply to future sales. Earlier orders retain their recorded release dates.

Do not interpret a sales total as an immediately withdrawable balance. Test-mode transactions and balances are simulated.

11. Reports, restrictions and complaints

Report suspected infringement, unlawful content or privacy concerns to support@donpic.com.

Identify the exact photo, album or profile URL, explain the issue, provide relevant supporting information and contact details, and confirm that the report is accurate to the best of your knowledge.

DonPic may investigate, seek clarification, remove or restrict content, temporarily suspend an account or terminate an account for serious or repeated breaches.

Action must be reasonably necessary to address unlawful activity, serious breaches, fraud, security risks or binding legal requirements. Decisions should be proportionate and consider available information.

Where required by law, we will explain the decision and available means of challenge. You can ask support to review a decision and provide relevant evidence. Urgent protective action may precede notice.

Restrictions do not automatically forfeit legitimately earned money, override refund obligations or remove applicable appeal rights.

12. Availability, changes and legal rights

Maintenance, faults and external providers can interrupt access. DonPic does not promise uninterrupted service or immunity from unauthorised copying.

Nothing in these terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights or applicable liability for fraud or personal injury.

We will give notice of material changes to fees or these terms as required by applicable law and contract. Changes will not retrospectively alter completed purchases or accrued rights.

Changes to recurring charges must be clearly notified before taking effect, with any legally required opportunity to cancel. Business users may have additional notice and termination protections.

These terms are governed by Maltese law. If you act as a consumer, this does not deprive you of mandatory protections under the law applicable to you or restrict courts available under applicable consumer jurisdiction rules.

For questions or complaints, email support@donpic.com. Where applicable, consumers may seek assistance from the Malta Competition and Consumer Affairs Authority or the relevant consumer authority in their country.
